1. Acceptance of Terms
By accessing or using cleanmattress.com.au (the “Website”) and engaging CleanMattress’s services (the “Services”), you (“Customer,” “you,” or “your”) agree to be bound by these Terms & Conditions (“Terms”). If you do not agree with any part of these Terms, please do not use the Website or our Services.
2. Definitions

CleanMattress (“we,” “us,” “our”): The business operating under the name CleanMattress.

Customer (“you,” “your”): Any individual or entity that accesses the Website or books Services.

Service Booking: An arrangement by which the Customer schedules a mattress-cleaning appointment through the Website, phone, or another authorized channel.

Booking Confirmation: An email, SMS, or other written notice from CleanMattress confirming your appointment details, including date, time, and service scope.
3. Eligibility

You must be at least 18 years old or possess legal capacity in your jurisdiction to enter into a contract with CleanMattress.

By booking or using our Services, you represent and warrant that you meet these requirements.
4. Service Overview

CleanMattress specializes in deep-cleaning and sanitizing residential and commercial mattresses.

Our Services include, but are not limited to: free contamination testing, high-powered extraction cleaning, UV-C sterilization, steam or dry cleaning, and hospital-grade sanitizing mist.

All Services are provided subject to these Terms, as well as any additional instructions provided at the time of booking.
5. Booking & Payment

How to Book
-
You may book Services via our Website, by phone, or through any other channel authorized by CleanMattress.

A Booking Confirmation will be sent once you select a date and time and provide required details (e.g., mattress size, location).

Pricing & Fees
-
All Service prices are specified on our Website or in promotional materials.

Prices are subject to a minimum job value (e.g., $179–$199, depending on location).
-
Specialized stain‐removal or biohazard clean-ups may incur additional fees, determined after on‐site inspection.
-
New-mattress‐cleaning services cover contamination areas up to the size of a dinner-plate. Larger contaminated areas may not be fully treatable, and we may recommend replacement.

For safety reasons, only one side of King/Super King mattresses is cleaned, per Occupational Health & Safety guidelines.

Payment Terms

Payment is due in full upon Service completion, unless otherwise agreed in writing.

We accept major credit/debit cards, bank transfers, and other payment methods displayed at checkout.

If you fail to pay within seven days of invoice, CleanMattress reserves the right to charge a late-payment fee of 5% of the outstanding balance per month.

Deposits & Confirmation

For certain bookings (e.g., large commercial orders), a non-refundable deposit (e.g., 25% of total cost) may be required to secure your appointment.

Your booking is not confirmed until you receive a Booking Confirmation.

Cancellation & Rescheduling
-
To cancel or reschedule, you must notify us at least 24 hours before your scheduled Service.

Cancellations with less than 24 hours’ notice may incur a cancellation fee of 50% of the scheduled Service cost.

No-shows will be charged 100% of the scheduled Service cost.

If we need to reschedule due to technician availability or safety concerns (e.g., unsafe work environment), we will provide you with alternative dates and times.

6. Service Conditions & Limitations

Before our technician arrives, you should remove any bedding, fragile items, and obstacles from the mattress area. Failure to do so may delay Service or incur additional fees.

We are not responsible for damage to mattresses that are already significantly worn, structurally unsound, or have irreparable defects.
-
While our methods are designed to remove common allergens, bacteria, viruses, and dust mites, we cannot guarantee 100% elimination of all contaminants.

CleanMattress is not liable for preexisting mattress damage (e.g., broken springs, torn seams) discovered during cleaning. If additional damage occurs due to preexisting faults, liability is limited as described in Section 9.

Any upholstery or attachments (e.g., pillow tops, integrated headboards) may require separate pricing and are subject to inspection.
7. Access & Customer Cooperation

You must provide safe, unobstructed access to the mattress and surrounding area.

If access is blocked or unsafe (e.g., electrical hazards, water leaks), the technician may need to reschedule or refuse Service without refund.

You agree to inform us of any special circumstances (e.g., medical conditions, hazardous contaminants) that could affect the cleaning process.

If our technician or subcontractor encounters unsafe conditions (e.g., aggressive pets, unstable structures), they may pause or terminate the Service for safety reasons.
8. Intellectual Property

The content on the Website (text, graphics, logos, images, and software) is the property of CleanMattress or its licensors and is protected by copyright, trademark, and other laws.

You may not reproduce, distribute, modify, or create derivative works without our express written permission.

“CleanMattress” and associated logos are trademarks owned by CleanMattress. Nothing in these Terms grants you any right, title, or interest in these marks.
9. Warranty Disclaimer & Limitation of Liability

All Services and Website content are provided “as is” and “as available,” without any warranty (express or implied).

CleanMattress makes no guarantees regarding the absolute removal of stains, allergens, microbes, or other contaminants.

We do not guarantee uninterrupted access to the Website or flawless Service performance.

Limitation of Liability

To the fullest extent permitted by law, CleanMattress’s liability for any claim arising from or related to these Terms, the Website, or Services is limited to the total amount paid by you for the specific Service in question.

Under no circumstances shall CleanMattress, its directors, employees, or contractors be liable for any indirect, special, consequential, incidental, or punitive damages (including lost profits, loss of business, or loss of data) arising out of or in connection with your use of the Website or Services.

This limitation applies even if CleanMattress has been advised of the possibility of such damages.

10. Indemnification
You agree to indemnify, defend, and hold harmless CleanMattress, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in any way connected with:

11. Termination

CleanMattress may suspend or terminate your access to the Website or Services at any time, without notice, if we believe you have violated these Terms or pose a risk to our operations, reputation, or other customers.

If either party materially breaches these Terms and fails to cure the breach within 14 days of receiving written notice, the non-breaching party may terminate the agreement.

Sections 6, 8, 9, 10, 11, 12, and 13 survive termination.
12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Queensland, Australia.

Any dispute, controversy, or claim arising out of or relating to these Terms or Services shall be resolved as follows:

Negotiation: Parties shall first attempt in good faith to resolve the dispute through informal negotiation.

Mediation: If negotiation fails, the dispute may be submitted to mediation under the rules of the Australian Centre for International Commercial Arbitration (ACICA).

Court Proceedings: If both negotiation and mediation fail, either party may initiate proceedings in the courts of competent jurisdiction in Queensland, Australia.

You agree to submit to the exclusive jurisdiction of these courts.
13. Changes to Terms

We may update these Terms at any time—for example, to reflect changes in our Services or legal requirements.

14. Severability

17. Entire Agreement
These Terms, together with any Booking Confirmations and our Privacy Policy, constitute the entire agreement between you and CleanMattress and supersede all prior or contemporaneous understandings, representations, warranties, and agreements (both written and oral).
